 Louisa,
   Thank  you  for sending  the  copy of your letter and also I thank you too for having some of your time reading
my Blog 
   Yes  the Mediation was occurred 19 September 2014, and May 2015   the Corporation
received  the required  Documentation  from the John Miller Law Firm 
I  do  hope by this time that the Corporation have received further instructions from my lawyer John Miller as it is
nearly 2 years  in few more months  after the  Mediation
 
I  refer  to  paragraph 2   == It saddened  me  to read    what  has been  done  about   this   when  it  started  with 3 letters to ACC I  can add  so much more  two  this  issue 
Then is  the issue  about my  taxis
 
Also   what has  become of  the   question  about short pay   from first class  fireman  to  senior  fireman back in  1979 on  we  just  found  out  about in 2014
 Now  the other  issue is   you now have  a copy of medical letter  from my  Doctor  about  TBI == which the  symptoms  i have had   for  a long time   re myodil
Further  tests  are now on  the  way including full  CT scan
Then  there is  the  asbestos's  which  you  have  accepted == used  another name  for it   ACC have  accepted it   but  won't  pay out  
 
What  I am  wanting  ACC  to  do  is  to have  a full investigation  then   pay up  instead  of  declining 
I  am  not  letting  this  go away and  as  you maybe  aware  it is in Parliament  and is  going  ahead   well== It has  been  accepted  by  the  speaker of  the  house  with submission  starting  to  arrive   when  submissions  haven't  been  called  for yet 
 
What is ACC going  to  do about other  sufferers  information   that I have on my   files
 
I  am now   going   to other  web  site with my  blog and  having  a  good  response 
In my  case  I  hold ACC fully responsible for  the loss of  my  home==Taxis=  and  a raft  of  other  problems  which  would not  have  happened  if  ACC had  done  there  job  properly  in  the  first  place and  to accept Myodil in  the  brain   which is  a fact causing TBI  and now  the  other  is  asbestos's

This has blown me away  and  am  having  trouble  putting  this into  words== I  am so  wild

First  I am out  here  to help  sufferers  and  do my  best

Do I  trust ACC  and  the powers  to be  the  answer is NO

 Do I  trust  people ==  well I  would like  to  think  so

On  the  26th  April at approximately between 4-30pm-5pm

 My  wife  and I had  a knock  on our  door  and  found  2  men in  blue  one  Sergeant

They  came in  one  going  with my  wife  to the  dining  table   the  Sergeant  into  the lounge ==He  asked me  to turn off  the TV

He  started   that   the police  have had  a complaint  about me [ An Anonymous caller]  That I  was going  to  blow up or planning or threaten  to  bomb  ACC He  also  added  that  the police have  accessed my  blog  and  that  they have  been in contact  with ACC

 My  understanding is  that   they have  accessed  my PC  as  well but have not  taken it  away

The  police  asked me to look in  my  garage I said go to it  I have  nothing  to  hide

After  being   here  for  ¾ of  an hour  and  as  they  were  leaving   they  mention  a  name  and  did I know him  My answer  was yes

 I told police  ACC  are  a  pack of mongrels  who I  have  been  fighting  for  years But  will not  threaten them 

My  job  before  as  a  Fireman  is  to  protect  and  save  people  life 

On  the 28th  I  rung police   and  am  now  wanting answers   still  as  at  today  nothing

Whoever is making  false statements   to  Police  is  a very  sick= evil vindictive  nasty  person  with  no  bases   to make  statements  like  this

What damage  has  been  done

If  any  person knows or knows  of someone   that is  so nasty  please contact me  urgent

This person should be  charged   what  he  or  she  have  done  is  criminal

 had similar years ago seems when I backed off posting the crap stopped. I do believe ACC does have black operators that make this type of trouble for tail liabilities.

   Forgive me John Huntley but I missed your blog. Do you think if it was very serious the cops would've sent more than two sworn staff? FGS you're a retired firefighter, so ACC isn't your sole income now. We know who truly did make threats to bomb ACC Takapuna, New Zealand Plus we all saw those YouTubevideos where that awful Dermot & scruffy David mentioned you. IMHO This reeks of the same nasty trolls connected to the Takapuna Beach plotter and who've since made death threats against myself and my sick disabled mother in care, under their erroneous assumption I am the non university educated blogger who has unsatisfactory English grammar (their, there etc). Why were the cops in your garage/shed so long? Smells of a fishing expedition. This is to inform you that this isn't taken off line I wil be including you in defamation case as my address and my children's names are mentioned including about me and my wife
 
Please remove now unless removed by noon Tuesday a lawyer will be employed to take this matter to court

In  the  past I have  been  there  to  try and  help  others  as  so  many of  us  have

I  remarried in  2004  and  that is  were  I  will start this part from or there about

We  where  living  at 67 Clotworthy  Cre   and in 2006  my  wife  went  to Philippines  to her daughters  wedding  for  3  weeks

We had  also  taken   a  ACC sufferer in   Michael Hill who had  no  were  to live  What  one  hell of  a  mistake Told   him  to  leave== He  was  gone  in  about  20 minutes

At about  the  same  time  I think Ken Miller introduced me   to  Warren Foster  who  came  from  the  UK  to  help  his mother  who  was  fighting ACC  Warren  devoted his   time   to  this  cause  and  at  the  same  time i  was introduced  to Allan Thomas == The  first  time I  meet  Allan  was  at  Warrens  Mothers place   I  took a dislike  to  him  But  had  trouble  with Allan  in  the past over   trying  to arrange  an ACC meeting through ACCforum.org  site  in  Rotorua  with   some  good people

The  second  time  I  meet Allan  was  at  67 Clotworthy  cre   with Warren == Ken Miller and others  think Douglas Weal  was one and Michael Hill

Our  aim  was  to help Warrens  mother   nothing  else What  was  said  behind my  back  I  don’t  know

This meeting  went  right  through  the  night

In most  cases  I  attended  review  hearings   with Warren one  time  a   large  group   and in others  was  alone  with Warren

Then  came  more  trouble   with Allan==  I arranged  a meeting  with Dr Jan  White  in  Wellington.

Present   were   My  Wife  and  myself==  Ken Miller= Magna carta or John  Howard =Peter  Sara

Allan Thomas  did not  like  this  at  all   kicked up merry hell

 This is  when I  decided  to  pull out of  the   ACCFORUM>ORG  site   as  I  didn’t  need  this  shit  and  trouble

 It  was about this  time  I  received  a  phone  call  from Ken Miller about Allan Thomas  was  being  investigated  for  threat of  blowing  up  ACC

I did  receive  2  phone  call  from  Allan Thomas about  the  same  time  ++I  was not  interested

No body   contacted me  over  this  issue  but   I knew   nothing  about it  anyway   and  would not  have been  able  to help

 From  then I  stopped  all meeting  at our home

This Rex  He is  using  an  alias    name == Who ever  he  is  I class him  as   one of  the low  life  looser  and  scum

  Have laid a  complaint   with police  so I hope   it  comes  back  to bite  them in  the ass

[14/05/2016 10:16:12 p.m.]  Hi John, lets chat Sunday, there is chat about the meeting held long ago at your place with Ken Miller and Douglas Weal, there is chat about the allegations against Alan thomas and the " Takapuna Plot" to blow up ACC years ago, so..................have a good think about that meeting, I have said online that you are a facilitator for a place for people to meet about ACC issues, but anything else malicious is due to other people

Legislation, Guidelines & Code Breaches by ACC:

1. Repeated non disclosure of correspondence regarding Bronwyn’s claim when requested.

2. Extensive disclosure of other claimant’s information to Bronwyn

3. No ability to restrict unauthorised access by 2500+ ACC staff and contractors to files, or medical files

4. Medical records (considered in law to be the most sensitive of personal information) are not given protection which is appropriate to their status and are treated as general documents.

5. Lack of procedure around dealing with statements of correction to incorrect reports

6. Threats of legal action against Bronwyn’s GP for refusing to disclosure non-injury information. Misuse of criminal provisions in ACC legislation.

7. Collection of information for an unlawful purpose

8. False written and oral statements by ACC staff with the purpose of unlawfully procuring medical reports for pecuniary purposes.

9. Defamatory statements by ACC employees

10. Exceeding lawful powers by investigating injuries for which no claim has been made.

11. Derogatory emails by ACC staff

12. Excessive Access to Bronwyn’s files – 1948 accesses within 3 ½ years, by about 150 different individuals, of which 1100 were in a single one year period.

13. Staff accessing files against management instructions

14. ACC167 Consent – used to coerce claimant’s into authorising otherwise unlawful collections of information.

15. Collection of personal information without claimant’s knowledge &/or attempted collection without knowledge

16. Collection and attempts to collect information unrelated to injury/claim

17. Imbalanced and biased decision making by Corporation

18. Covert/inappropriate communication to assessors which bias & negatively influence outcomes against claimants

19. Decision making without reviewing EOS

20. Lack of workability of electronic medical file for lawfully compliant decision making

21. Coercion, Harassment & Bullying, Unreasonable approach in management of claims. Use of threats of disentitlement to coerce

22. Dictatorial approach of Case Managers, failure to make reasonable accommodations for claimant needs.

23. “cherry picking” of unfavourable phrases from medical reports which contradict the ultimate conclusion.

24. ACC abusing its monopoly position by limiting the pool of qualified medical assessors to a select group (some individuals assessors are paid up in excess of $1 million annually for services), leading to the appearance of bias and unfair market practises.

25. Failure to demand adherence of staff to State Services Code of Conduct and to take appropriate action for  breach

26. Failure of Office of Complaints Investigator to independently investigate complaints

27. Failure of Office of Complaints Investigator to follow a reasonable process when conducting investigations

28. Failure of Office of Complaints Investigator to validate the responses provided by ACC with the claimant for accuracy

29. ACC’s case management approach to Bronwyn is disruptive and destructive of her ability to rehabilitate/work part-time

30. ACC staff deliberately lying and writing false reports

31. ACC staff making clinical decisions without appropriate qualification

32. ACC staff making clinical assessments without medical competency

33. Deliberate interference in independent medical assessments

34. Prejudicial correspondence with independent assessors prior to assessments communicating ACC's desired outcome - that injuries are spent &/or due to non-injury causes

35. Provision of unqualified, non-specialist opinions, by ACC internal medical advisors, contradicting existing specialist advice, prejudicing independent assessors and compromising their independence

36. Branches/Units having Case Managers who made an initial decision then conduct an administrative review of a matter before being sent to DRSL for review

37. Taking advantage of disabled claimants for actuarial/financial gain

38. Poor decision making which adds cost to the Corporation

39. Poor OCI processes which adds cost to the Corporation

40. Lack of flexibility over assessments/appointments/referrals

41. Lack of reasonable consultation and flexibility over assessments/ appointments/referrals

42. Unreasonable referrals/assessments  processes which are exploitative e.g., chaperones, multi-party assessments, lack of privacy & dignity;

43. Focus on avoiding liability at the expense of effective early rehabilitation

44. ‘Silo’ culture where case managers are unaware of ACC’s own research into rehabilitation best practice

45. Constant churn of case managers – each new case manager is unaware of the medical evidence on file leading to poor decision making and is unaware of claimant’s issues; Avoidance strategy for accountability of actions.

 Both Guada and I wish to thank people that have supported us == I have been cleared of any wrong doing It has now been reported to police complaints and after a long phone call from them they are now investigating

It was nice to talk to you last  Thursday.

 

As discussed here is the file number for the ACC matter 160426/1989

 

As confirmed by Sergeant Wayne MANATON we received an untraceable call via Crimestoppers. As this is an anonymous external service we cannot trace calls and identify the caller.

 

There is no evidence to link you to this complaint and as a result this matter has been filed.

 

I would encourage you to think about a Harassment Order if things continue and there is evidence to link this to a specific person. Likewise please call me if you need any further help.

 

Harassment Act 1997

 

Meaning of harassment

(1)

For the purposes of this Act, a person harasses another person if he or she engages in a pattern of behaviour that is directed against that other person, being a pattern of behaviour that includes doing any specified act to the other person on at least 2 separate occasions within a period of 12 months.

(2)

To avoid any doubt,—

(a)

the specified acts required for the purposes of subsection (1) may be the same type of specified act on each separate occasion, or different types of specified acts:

(B)

the specified acts need not be done to the same person on each separate occasion, as long as the pattern of behaviour is directed against the same person.

(3)

For the purposes of this Act, a person also harasses another person if—

(a)

he or she engages in a pattern of behaviour that is directed against that other person; and

(B)

that pattern of behaviour includes doing any specified act to the other person that is one continuing act carried out over any period.

(4)

For the purposes of subsection (3), continuing act includes a specified act done on any one occasion that continues to have effect over a protracted period (for example, where offensive material about a person is placed in any electronic media and remains there for a protracted period).

A while back you asked about the criteria for ACC to accept a claim for asbestosis.

Under current ACC legislation, people who suffer a “personal injury caused by a work-related gradual process, disease, or infection” receive cover when they met the three-part criteria set out in section 30(2).

Asbestosis is specifically listed as an occupational disease in Schedule 2.  According to Westlaw, this means the three-part criteria do not apply. Rather:

There is a presumption that when a person suffers a personal injury, as described in Schedule 2, and that person has been in employment which exposes them to risk of the disease specified, then cover should be extended…Application of this section will require a thorough occupational history, establishing the exposures to the hazards linked to the onset of the disease.  Chest x-rays and lung function tests should be performed for those with lung abnormalities.

An ACC Review on asbestos-related disease published in 2004 defined asbestosis in the following way:Hi John,

TECHNIQUE:

Non-contrast high-resolution CT scan of chest protocol. FINDINGS:

There is bilateral diffuse emphysematous process mainly in the form of

centrilobular and panlobular emphysema. There is bilateral lower lobe

predominant subpleural reticulation, traction bronchiectasis, with some

ground glass infiltrate on the right side and dense scarring of on the left

side of likely representing interstitial pulmonary fibrosis. No pleural or

pericardial effusion.

Bilateral pleural thickening, plaques and calcification in keeping with

asbestos exposure.

No evidence of significant mediastinal lymphadenopathy. No axillary or

supraclavicular lymphadenopathy.

Mildly dilated gas containing thoracic oesophagus. No evidence of

enlargement of pulmonary arteries.

Calcification of coronary arteries noted.

No destructive bony lesion within the imaged bony skeleton.

Degenerative changes seen within lower cervical and thoracic spine.

IMPRESSION:

Bilateral diffuse emphysema.

Bilateral lower lobe subpleural interstitial pulmonary fibrosis, more

evident on the left side.

Bilateral pleural thickening, plaques and calcification in keeping with

asbestos exposure.

No evidence of pulmonary artery hypertension.
