This is one of  3  letters  from  the  same  person   I  will call him   the  Get or motor mouth 

My  x s = partner 

The  person  that I trained   as  a taxi driver  back  in  early 1977 ==  then  he  worked  for  me==  then  when i  was in  hospital  slept  with my   x wife   also  bleeding

the business  dry   He is  well known   to  the Lower Hutt  police on  others matters  as well

 

He has  raped my  2 daughters   and I believe  others  as well

this is  6 months after OP Ho sorry  After i  came out of  Hospital  and  the letter  states   for many months  have  been  working 

 I  had  trouble  walking   let  alone  keeping my  balance   and by November 1979  had a  live in  house keeper  to help  with children  and  help around home

Well   this Mr Tain    he  stated   This  funny little man came  to see me ===  then listed  all  my medical  problems 

 

 Friends   used  to come  and see me  and often  found me blacked out on the  floor

I  finally  joint up  with the  solo patients  and  became  president ==  We often  had  a lot  to do  with Napier  branch  When  I meet  my  when Wife

 We married  and had  2  more  children  and one  of hers

 My  eldest  daughter  went  to live  with her mother  against  my  wishers

On  the  5th of Nov  I  got  a  phone  call   to come  and pick up   your bitch  as  she had been  raped===  you  can  guess who

 I  drove  down  to Wellington  picked her up   and headed  for home

The X blamed her  for this   I think  she  was 13

A short  time  after   We moved  to Taumanui  to get away  from trouble   brought  a cheap home  and  tried  to settle

We had  more  trouble  that started to come  between my  then  new wife the children  and  myself 

That didn't  work out   so by  1989  moved  to Wanganui

I said  to my  self   maybe  this  time

Well walked into Hell

 After moving  around  a bit  we finally  settled on a  section  erected  a large  garage with a batch and lived in  that 

 I  am  a little  confused   about  some  things  and  times   but  will  try  my  best  to explain

on  one occasion  our lovely  friend  who lived nest  door  found me  again blacked out  rushed  to hospital   then the hospital  told  to  go home  and contact  your  doctor

3 days later   went  to doctors   he told  me   the  bad news  We  found  stuff in  your brain  think it is tumors    O  hell

  then went  to Palmerston  Hospital  Had  test was  sent  home  again  told  to contact   doctor  again

My  doctor  Ian Little   told me  to sit  down  have  good news  and  also bad  news 

Stated   not  tumors   but Myodil in my  brain====Me  what  the hell is Myodil,  he told 

I  wrote  away  for all my medical  records 

Started investigating  and  ho   what  the hell have i uncovered

Went  to  Jon Morgan   the  reporter  for  the Dominion news paper    this  ran  for   many  weeks  as  other  came forward

 Then  60 minuted  ran a story on TV

I  was also approach  by  cover  story  that also  ran  i story total  4 hours  a good  one

When  came  the  real shit  from ACC

At  the same  time  I was also informed   that  my  youngest  daughter   who I  really  never knew  was  raped and  that I had  to pay  child  support

I hit  the  roof  as i didn't get  any  child  support  from my  x wife   for my  5  children   Yes again  you  can guess  who

Then  came  the police   as someone  had  put a sign on the Wainui=o=mata  hill  stating  he  was a rapist

I  said  to  the police   when  you  do find out  who put  the  sign  up please let me know  so  I  can  shake   his  hands

 This is  the Get   that i  trained  as a taxi  driver  then  he  worked  for me  with  5 other  drivers

This is  the get  that  wrote   to ACC stating  that i  was  working  Driving taxis building  and  driving  milk  truck is  letter is on posting   do have more  to  come 

 This is  the Get  who  was sleeping   with my X=wife

This  is  the guy  that  raped  my  girls  all well under  16

 Builders  report  already on post  earlier

Milk run  was owned  by my mate  who  also  worked  in  the  fire service  He  sold the milk  run  before i had my  accident   I  did  ride  with him  about  twice If my memory is  correct He  then brought  a Taxi

ACC believed him being  the GET   over me    But ACC didn't  think it out  I was in Wellington  hospital  a good  part of  the time   and  recovering   from  the OP  the  rest  not knowing   that  the myodil  was in  my brain

At about  the same  time I went  to work part  time  for  Field Air   I had ACC blessing  but  because of  health  and  the dangers   I left  also telling ACC

Some  short  time  later  my  ERC  stopped   I  rung ACC  and  they told me  that I was now  working  for Wanganui Airoworks

I  rung Airoworks  when i  found  this out  I could hear  the  boss  with the phone  well away from my ear == It  do  get  sorted and ACC  reinstated my  ERC

Now  with all this  crap I went  to a lawyer   and  proceeding   started 

3  review hearings   then  to the  high  court  We had a  win

 then came  the  real shit  ACC  sent money  to social welfare 44-000  after  receiving  a letter  that  MR huntley  was not  on our  books

 had  to  pay  legal aid back = heavy taxes  and  a huge legal  will

 ACC had  to  pay  from 1980  to 1985  no ERC

then  ACC had  to pay  because   they  paid  only 80% of the 80%  that i was  receiving in  the  fire service

Lawyer   then  went  for interest

So all this  time  ACC made me struggle  through life

Then came  another  bomb  shell  ACC had a private  eye  spying  on me   One of my  children  saw  him

See  the  Paul Holms  show

At  about  the same time  We brought  a old  home  and  had it moved onto  the  section  The movers  placed iton piles and  painted it  part of  the deal

This   started  to put  a real strain on our relationship

As  time  went on and  in 1999  we  moved  to Whangarei  and  brought a nice  home

In  the  year 2000 ACC wanted all  this money  back  Also  covered  in the Paul Holms  show

 more  still to  come

I forgot  to mention   that in the late  1990s I had  a visit  from  the  court  trying  to serve  papers on me  for  child  support ==  now  this is  for my  daughter  i never knew and  was in  the  care of  my  x=wafe  and  the Get ==Now  after  bringing up 5 children  without  child  support  from my  X  this happened ==  the  stress and strain  was getting  to much  for my  then  wife

Within  the year  yes my then  wife  walked out  now  leaving me ===what is  going on ==ACC have  won again  another marriage  bites  the  dust

By  this  time   I am  taking  a hard look at myself  With all  the problems over  the years  it  was to much

The  rape of my  daughters.

The legal system  and its  costs

My health  and ACC  with  private  eyes  spying on us   and many  more  issues

Short of money  wondering  were  the next  cent  was  coming  from

So had  to pick myself  up  again

Through  friends  I  met  a beautiful lady  from   the Philippines

We  got married on  the  1st May 2004

She  is   kind , loving= caring= and understanding

 In  the  last 5 years   things  have  taken  a turn for  the better

I  was  told  to look  at changing   doctors   which I  did  My new  doctor  sent me  to the  hospital for many  checks   One  was  to a specialist   who   stated  that I had brain damage  though it  maybe linked  to Myodil  the blackouts  were  epileptic   think  that is spelt  right

Then came    they  found  that I had  asbestos

ACC  accepts  that   but  won’t pay out   and have  down  graded it

I have  taken  all this   to parliament  who is  working on  this now   

Also have  another  legal team  working on  it

Finally  My lawyer  spent   3 days  with me   to  go  to a  fairways review

 I  had  requested  all my Fire service  records   But  didn’t pick  up   that AC were only paying me  on the first class  fireman’s  drivers  pay  In actual  fact  I did   get my promotion   to senior   fireman’s  driver   so ACC were is  the  extra  pay  you are owing  me   which amounts  around $44,000 plus interest

now  for  the  final  last  few  years

 I  did  have  a  visit  regarding  my  medical misadventure   about  2006   that was  another  white  wash

at  the  same  timer  i was told  that  if i had  myodil in my  brain  I will be  covered  that also  was a joke

 In  2007 I  made  arrangements for  4 of us   to visit Jan White  who  was   ACC  CEO  2  from up north and  2  from  the  south Island

ACC paid but  wouldn't  pay  for my  wife  who I needed with me   I still have  the  voice  recording of the  whole meeting

Mr  McGreevy  was  also  present

The meet  came  to an end   with  a COGS group formed   and  that ACC would  arrange for  a person  to come  and visit That person  was Mr John Greene

A  Warren Forster  was  present   on  the  first  day  which lasted  2  days

John Greene  took all my  concerns away  with  him  but  did not  address in  writing most issues  == then instead    through ACC  sent me  a payment  of 12,000

This  was a payoff  to shut me up   What  an insult

more  to  come

I am a life  time  smoker   +++  this is incorrect   I  went  for years no smokes  started up   then  knocked  off  this  happened  4 times in my  life 

 In all times  it  was  the stress  that started  me up again

Thank you for referring Mr. Huntley Whom I saw on 46 September 1996.with reference to assessment of the possibility of arachnoiditis.

Thank you also for copy of Philip Baker's letter dated 6 April 1995 which gave chronological details as well as the various symptoms experienced by Mr. Huntley and his findings.

For my own record Mr. Huntley told me that he had an accident in 1977 causing inipry to his neck. In 1979 he had a myelogram for which Myodil was the contrast medium used. A

cervical laminectomy was done subsequently. Mr. Huntley claimed that since the myelogram he has been troubled by pain, electric shock sensation, prickling feeling in his neck, arms and in different part of his body. There has also been severe and persistent headache, spasms of his muscles in different areas which on several occasions led to suspected heart attacks or stroke leading to admissions to Hospital.

He hadfurther surgery, an anterior cervical spinal fusion in 1990. Despite of this his symptoms continued unabated. Exertion and particularly vibration such as in a motor car

would aggravate his discomfort. In addition he has blurring of vision, dizziness, vile taste in his mouth, variable sensitivity in his smell, constant tinnitus, intermittent disturbance of

balance, urgency and dribbling of micturition, constipation, decreased libido, pain in his back and weakness'of his legs. He has problem with his sleep because of the discomfort and mood swings.

Examination showed no abnormality in the cranial nerve territory, in the limbs there was no significant increase in tone or loss of strength. The tendon reflexes were all present and the plantar responses were flexor. Light-touch sensation was normal. Pinprick and temperature sensations were apparently impaired in the hands in a global manner. There was no atrophy of any muscle groups nor was there any evidence of dystrophic changes. There was no

evidence of cerebellar dysfunction.

 

 

Page 2 - Huntley

 

I reviewed his spinal x-rays as well as recent MRI scan of his head and spine. These showed degenerative changes. There were some scattered droplets of Myodil in the base of the cranial cavity. There was no MRI features of arachnoiditis.

Comment:

From the information available, both from Dr. Baker's letter and Mr. Huntley description, the symptoms were nonspecific, variable, global rather than segmental, and not consistent with peripheral nerve distributions. The absence of significant or definite neurological signs and the absence of clear radiological signs of arachnoiditis would in my opinion, make the suggestion of arachnoiditis untenable. The presence of Myodil droplets in the cranial cavity does not in itself constitute evidence of arachnoiditis.

On the other hand his symptoms are consistent with spinal spondylosis which could arise from trauma, operative procedures, degeneration and other idiopathic factors.

You asked me if there be any treatment available for Mr Huntley, I would have to say that Mr. Huntley is convinced that he has arachnoiditis due to Myodil, according to information he had gathered from his own research. Conceptually we are on opposite directions, and it would be impossible in this situation to create a therapeutic milieu to develop a successful treatment regime.

MR1 CERVICAL SPINE:                            23.8.95

Clinical History:

54yr old male with symptoms referred to the cervical spine and foramen magnum. Technique:

Sagittal and axial Ti and gradient echo images were done for the foramen magnum and cervical spine.

Findings:

 

The MR1 films were read in conjunction with the plain films including oblique views for the intervertebral foramina. Sazittal images show laminectomies of C5 & C6 with fusion of C5, 6 & 7 vertebral bodies leading to malalignment and localised cervical spine kyphosis in the lower cervical region with deformity of the thecal

sac due to anterior compression and posterfor passive dilatation, slice No. 13 & 6. There are alsosigns of chronic degenerative changes with osteophyte formation encroaching on both intervertebral foramina at the levels of C4/5, C5/6, C6/7 & cwri especially evident in the oblique views of the cervical spine (arrows).

No lesion could be demonstrated in the region of the foramen magnum.

Conclusion

Previous laminectomy and vertebral fusion of C5, 6 & 7 with localised cervical spine kyphosis and thecal sac deformity in the lower cervical spine due to anterior compression. In addition there are signs of chronic degenerative changes with osteophyte formation encroaching on both intervertebral foramina in the mid and lower cervical region. No lesion could be demonstrated in the region of foramen magnum.

As you are aware, an investigation into your concerns was recently carried out for ACC by Mr J G Greene. This letter is to advise you of ACC's response to that investigation.

ACC has carefully considered Mr Greene's findings, and all his recommendations.

Mr Greene has noted some significant lapses in ACC's service to you, particularly in the early years of your claim's management. There are also other issues which Mr Greene's report has considered in order to recognise their general relevance to your current complaint We acknowledge those issues, and your expressed concerns about them.

Thank you for referring this claim for asbestos-related disease.

Mr Huntley is likely to have been exposed to asbestos in burning buildings when employed as a fireman in New Zealand from 1974 until 1980. The health hazards were not recognised at that time.

The rest of the occupational history is not given and should be obtained.

Mr Huntley complains of exertional breathlessness. Recent chest imaging showed moderate bilateral emphysema and calcified pleural plaques bilaterally. There was no evidence of pulmonary interstitial fibrosis to suggest asbestosis.

In emphysema there is destruction of the alveoli (air sacs) of the lungs. It is usually caused by chronic tobacco smoking, and I note that Mr Huntley smoked for many years.

Pleural plaques are scars on the pleura, the lining of the lung, caused by inhalation of asbestos. When very extensive can reduce the elasticity of the pleura and restrict expansion of the lungs so that they hold less air.

ACC accepts asbestos-related pleural disease as a personal injury when caused by a work-related gradual process. The three-part test for cover applies. In my view, these criteria are met in Mr Huntley's case and cover is appropriate.

There is no effective treatment for asbestos-related pleural disease.

Basic spirometry in September, 2008 showed a forced vital capacity (FVC) of 75% of expected for age and height and a one-second forced expiratory volume (FEV1) of 62% of predicted, giving a low FEVi/FVC ratio of 62% (normal >70%). There was some reversibility to bronchodilator but the improvement was non-significant. The forced expiratory flow rates (FEF) were severely reduced across the range, reflecting increased airway resistance.

This is predominantly an obstructive ventilatory deficit probably attributable to smoking-related emphysema. There may be a minor restrictive element as well from the asbestos-related pleural disease, which can stiffen the lung lining and limit the expansion of the lungs.

,JOHN HUNTLEY CLAIM NO: 65/78/340709

A recent audit of debtors in the Wanganui branch shows that John has a debt of $583.61 This debt is an overpayment of weekly compensation that arose on 15 March 1995 following payment of arrears. John may not recall this matter bearing in mind the other issues we have been dealing with recently.

As John is currently in receipt of entitlements Corporation policy relating to debt management obliges me to deduct a regular amount from these entitlements. This is authorised under the provisions of section 77(1) of the Act. I realise John's financial position and propose that 1 begin deducting $20.00 per week from his weekly compensation until the debt is repaid.

Doing this will leave his independence allowance intact. Alternatively I can deduct the debt from the independence allowance. In the interim I have begun witIlholding $20.00.

Thank you for your efficient handling of this matter and your full report. I am happy to accept your assessment of the situation.

'qithout entering into the actual admiListration-of the file, I must record my concern regarding the apparent pressures applied by the Union and by the Fire Authority regarding both the question of light work and earnings during incapacity. I find "sympathy

with your sympathies” but suggest that this aspect needs clarification at source. In terms of S.113(2) we are obliged to consider a claimants capacity to earn determined by his physical condition - not his Thion's or Employer's permission.

have never liked anonymous advices, but we are obliged to check them out. It may well be that the writer was a genuine "do-gooder" genuinely concerned about an apparent rip-off. If nothing elce he has achieved an in depth examination of a not particularly well handled file, so some good has resulted.
